Starting with the first successful kidney transplantation in 1975, the organ and tissue transplantation works have been continuously develeped. On December 9, 1988, transplantation takes a new dimension, and today, (approximately 60 people out of 1 million), it continues to give a chance of living to the people. Our foundation, besides advertising working, Religious Affairs, members of the parliament, media (especially TRT) and with the accepted law, numbered 2238 on 3rd June 1979, the organ and tissue donation became legal.
With the sensitiveness of our country's people and the recent improvement in the field of medicine; eye, pancratium and bone marrow transplantation can be made. Other organ and tissue transplantations will be made possible in the near future.
Health is one of the most important indicators of development in reaching to the life standard envisaged in a contemporary society and in the value appreciated to human element.

ORGAN AND TISSUE TRANSPLANTATION IS A PERSON RESPECT

The way of taking the organs and how they are taken from the person that donates are explained in 2238 number (The determining of the dead condition - Article 11 and the banning process related to the doctors - Article 12 are explained)
ARTICLE 3- The buying and selling of organs and tissues for a monetary sum or other gain is forbidden.
ARTICLE 4- Except for the distribution of information having scientific, statistical, and new characteristics, all advertisement in connection with the harvesting and donation of organs and tissues is forbidden.
ARTICLE 5- Harvesting organs and tissues from persons under the age of 18 or who are not of sound mind is forbidden.
ARTICLE 6- In order to be able to harvest organs and tissue from any person over the age of 18 who is of sound mind, a protocol, which beforehand the donor has approved of in writing and subscribed to verbally before at least two witnesses, should be approved by a physician. On the Harvesting, Storage, Grafting and Transplantation of Organs and Tissues (June 3, 1979)
ARTICLE 11- In connection with enforcement of this law, the case of medical death is established unanimously by a committee of 4 physicians consisting of 1 cardiologist, 1 neurologist, 1 neurosurgeon, and 1 anesthesiologist by applying the rules, methods and practices which the level of science has reached in the country.
ARTICLE 12- The physician who will perform the transplant surgery cannot be among the group which pronounced the donor as dead (Article 11).
ARTICLE 15- Those harvesting, storing, grafting and transplanting organs and tissues in a manner not conforming to this law, and those intermediating in such actions as the buying and selling of organs and tissues and those brokering same, in the case that it does not require any heavier punishment, shall be sentenced to punishment of two (2) to four (4) years, and of 50,000 to 100,000 Turkish Lira.
